Rightsholders & Budna
Budna respects intellectual property rights and expects its users to do the same. This policy forms part of the User Agreement and explains how rightsholders can report infringing listings and how Budna responds.

1. For all users
1.1 Do not list items that infringe trademarks, copyright, design rights, or other IP, including counterfeits, replicas, and unauthorised copies (see Prohibited items).
1.2 You are responsible for ensuring you have the right to sell an item and to use the content (photos, text) in your listing.
2. Reporting infringement (for rightsholders)
2.1 If you are a rightsholder (or authorised to act for one) and believe a listing infringes your rights, report it via Report on the listing, or contact hello@budna.se with:
- your identity and the right you hold (and authority to act, if applicable);
- the specific listing(s) and a link to each;
- a description of the right and why the listing infringes; and
- a statement that the report is made in good faith and is accurate.
3. How Budna responds
3.1 Every notice submitted through the reporting channels receives an automated electronic acknowledgement of receipt. The acknowledgement contains a reference number, the target service level (Budna aims to decide ordinary cases within 7 days of receipt), and a link to the appeal path described in §4.
3.2 Budna reviews valid notices and may remove or disable access to the listing, demote it in ranking, suspend or terminate the account, or restrict monetisation. Budna notifies both the notifier and the affected user of its decision and the reasoning behind it without undue delay.
3.3 For every restrictive action taken in respect of content provided by a user, Budna issues a statement of reasons to the affected user containing at least: (i) the scope of the restriction, identifying the specific item, account or function concerned and the duration of the measure; (ii) the facts and circumstances Budna relied on, including, where relevant, that the action was taken on the basis of a notice submitted under §2 or following an own-initiative investigation; (iii) whether automated means were used in detecting, identifying or deciding the action; (iv) the legal ground relied on, whether a statutory provision or a clause of the Terms of Service and the reason why the content is considered incompatible with that ground; (v) the avenues available to challenge the decision, including the internal complaint mechanism set out in §4, the out-of-court dispute settlement bodies referred to in §5, and the right to seek judicial redress before a competent court; and (vi) where required, submission of the statement of reasons to the European Commission DSA Transparency Database.
3.4 Budna takes prior events into account and acts against repeat infringers in accordance with §6, including by suspending or closing accounts.
3.5 Budna may inform a rightsholder where trademark infringement is suspected, and may share relevant information as permitted by law and the Privacy Policy.
4. Internal complaint and counter-notice
4.1 Any user affected by a moderation decision, including the removal or disabling of access to content, demotion in ranking, suspension or termination of an account, or restriction of monetisation, may submit an internal complaint against that decision free of charge. Complaints may also be submitted by notifiers who are dissatisfied with the decision taken in response to their notice.
4.2 Complaints must be submitted within 6 months from notification of the decision via support@budna.se. The complaint should identify the decision contested, the reference number issued under §3.1, and the grounds on which the user considers the decision to be unfounded.
4.3 Complaints are reviewed by qualified staff who were not involved in the original decision and who do not report to the persons who took it. Review is conducted under human supervision and is not based solely on automated means.
4.4 Budna issues a reasoned decision on the complaint within 14 days of receipt and informs the complainant of the outcome and of the further avenues of redress referred to in §5.
5. Out-of-court dispute settlement
5.1 Users who are dissatisfied with the outcome of the internal complaint procedure under §4, or who choose not to use it, may submit the dispute to a certified out-of-court dispute settlement body under Article 21 of the Digital Services Act. The decision of such a body is not binding on the parties.
5.2 Consumers resident in the European Union can also seek assistance with cross-border complaints from the European Consumer Centres Network (ECC-Net), in addition to the national consumer bodies identified in the User Agreement.
5.3 Additional certified out-of-court dispute settlement bodies will be named once selected. Recourse to an out-of-court dispute settlement body does not affect the right of either party to bring proceedings before a competent court at any time.
6. Misuse of notice and complaint mechanisms
6.1 Budna may, after issuing a prior warning, suspend for a reasonable period the processing of notices and complaints submitted by persons or entities that frequently submit notices or complaints that are manifestly unfounded. Budna may likewise suspend the provision of the service to users who frequently provide manifestly illegal content.
6.2 In assessing whether conduct constitutes misuse, Budna considers, on a case-by-case basis: the absolute number of manifestly unfounded notices, complaints or items of illegal content submitted within a given period; the ratio of those submissions to the total submissions made by the same person or entity; the gravity of the misuse, including the nature of the illegal content and its consequences; and, where it can be identified, the intention of the person or entity concerned.
6.3 Affected users are notified of any suspension under this section and may contest it through the internal complaint mechanism in §4.
